Transfer of executives and managers between US and foreign companies

  • The L-1A classification allows U.S. employers to transfer executives or managers from their foreign offices.
  • It also allows foreign companies to establish new offices in the U.S. and transfer executives or managers.
  • Valid for both established companies and new U.S. offices.

Requirements

General Requirements

Criteria for eligible employers and employees.

  • Both employer and employee must meet certain requirements, including a qualified relationship with a foreign company.
  • The employer must be doing business in the U.S. and at least one other country.
  • The employee must have worked in the foreign company for at least one year before the transfer.

Establishment

New Offices and Stay

Requirements for new offices and duration of stay.

  • To establish new offices in the U.S. it is required to secure physical premises and employ the manager or executive before the request.
  • The foreign company must transfer funds to the U.S. organization to demonstrate its ability to operate.
  • The length of the initial stay may vary depending on whether the U.S. operation has been operating previously.

Family of Workers L-1

Family benefits for workers L-1.

  • Transferred employees may be accompanied by their spouses and children under the age of 21.
  • Spouses can apply for work authorization and have no specific restrictions on where they can work.
