Who can access it?

  • The O-1A nonimmigrant visa is for individuals with extraordinary abilities in various fields (excluding the arts, film industry or television), including sports.

O-2 Athlete Companion Visa O-1

  • The O-2 visa is for O-1 athletes who assist in specific events.
  • In the case of O-1A, the O-2 must be essential to the success of the O-1 and have critical skills that an American worker cannot easily provide.

Stay

Period of Stay in O-1B Visa

  • Initial Duration: The maximum period allowed for initial O-1B visa applications is three years.
  • Time Determination: The USCIS will determine the time needed to perform the initial event or activity in increments of up to 1 year.
  • Change of Employer: In case of change of employer, a new period of three years is allowed.

Relatives of O-1 and O-2 Visa Holders

  • O-3 Eligibility: Spouses and unmarried children under 21 years of O-1 and O-2 visa holders may apply for a O-3 nonimmigrant visa.
  • Admission and Limitations: Holders of O-3 visas have the same admission period and limitations as holders of O-1 and O-2 visas they accompany.
  • Study, No Work: Holders of O-3 visas may not work in the United States under this classification, but may study full-time or part-time.

Additional Information

If a beneficiary O loses his or her employment for nonvoluntary reasons, the employer or agent must cover the cost of his or her return transportation.
