Visa-O-1A

O-1A Visa: Extraordinary Skill in Business, Science and Other Fields

  • The O-1A visa is for individuals with exceptional skills in business, science or other fields, or outstanding achievements in film or television.
  • O-2s are essential companions for O-1A with critical skills that cannot easily be replaced by American workers.
  • O-3s are spouses and children under 21 years of age holding O-1A and O-2 visas.

Eligibility for the O-1 Visa

  • The beneficiary must demonstrate extraordinary ability recognized nationally or internationally and come temporarily to the U.S. . to continue working in that field.
  • In science, education, business or sports, a level of experience is required that places the person in the elite of their field.

Evidence-O-1B

Evidence Criteria for O-1B Visa

  • Significant national or international awards or at least three of the following criteria.
  • Membership in associations requiring outstanding achievements, evaluated by experts.
  • Material published in media about the beneficiary and his work.
  • Participation of the beneficiary as a judge or significant contributions.

Stay-O-1B

Period of Stay

  • The maximum period allowed for initial O-1B petitions is three years. USCIS will determine the time needed to perform the initial event or activity in increments of up to 1 year.
  • In the event of a change of employer, a further period of three years is allowed.

Relatives of O-1 and O-2 Visa Holders

Spouses and unmarried children under 21 who accompany or join O-1 or O-2 visa holders may apply for an O-3 visa, with the same admission period and restrictions. They can’t work in the U.S. but they can study full-time or part-time.

Additional Information

If a beneficiary OR nonimmigrant is fired for nonvoluntary reasons, the employer must cover the cost of transportation back to their last US residence. U.S. If an agent filed the petition, they share responsibility.
