O-1B Visa: Cinema and TV

Visa 0-1B is applicable in:

  • Visa for exceptional skills in film or television.
  • O-2 visa for essential companions with critical skills.
  • Verification: Lack of qualified local workers and no negative impact on working conditions.

Eligibility Visa O-1 in Cinema/TV

  • The beneficiary must demonstrate extraordinary achievements in cinema or television.
  • These achievements must reflect a level of skill and recognition far above the common.
  • The person must be recognized as outstanding, outstanding or leader in cinema and/or television.

Evidence-O-1A

Evidence Criteria for O-1A Visa

  • Awards or at least three of the following criteria.
  • Membership in outstanding associations.
  • Material published in media about the beneficiary.
  • Participation as a judge or significant contributions.

Stay

Length of Stay

  • The maximum period allowed for initial O-1B petitions is three years. USCIS will determine the time needed to perform the initial event or activity in increments of up to 1 year.
  • In the event of a change of employer, a further period of three years is allowed.

Relatives of O-1 and O-2 Visa Holders

Family members of O-1 and O-2 visa holders, spouses and children under 21, may apply for an O-3 visa with the same admission period and restrictions, but may not work in the US. U.S. students may study full-time or part-time.

Additional Information

If a beneficiary OR nonimmigrant is fired, the employer must cover the cost of transportation back to their last U.S. residence. If an agent filed the petition, they share responsibility.
