Eligibility

EB-12 Visa for Multinational Executive

  • First preference visa eligibility based on employment.
  • Requirement to be a multinational executive or manager.

Requirements

Rating Ratio

  • Employer in U.S. with qualified link.
  • Continuous operation in the U.S. and another country for at least 1 year.
  • "Doing business" means providing goods/services systematically, not just office presence.

Qualifications

Requirements for EB-12 Multinational Manager or Executive

  • Work experience outside the U.S. in managerial or executive positions.
  • With the same employer, affiliate or subsidiary of the United States petitioner.
  • Minimum 1 year of employment outside the U.S. in the 3 years prior to processing.
  • Enter the U.S. to continue service as a Manager or Executive.

Portability

EB-12 Portability Multinational Managers or Executives

  • Change of job as manager or executive.
  • Even for an unrelated company.
  • Exceptions for differences in work responsibilities or occupational classification.
