Eligibility

EB-2 Visa for Professionals with Advanced Degrees

  • Eligibility based on advanced degrees or their equivalent.
  • Requirements for required work and documentation.
  • Proof of advanced degree or equivalent progressive work experience.

Requirement

Individual PERM Requirement Approved

  • Permanent Employment Permit (PERM) required and approved by the U.S. Department of Labor.
  • Before filing Petition EB-2 with USCIS.

Capacity

Ability to Pay

  • Evidence of capacity to pay.
  • Documentation includes net income, net current assets and beneficiary employment.
  • Evidence such as annual reports or tax returns are required.
  • Additional factors considered.

Portability

Portability for Professionals with Advanced Grades

  • Employer change for pending or approved I-140 beneficiaries.
  • Requirement: I-485 pending for 180 days or more.
  • New employer must offer full-time permanent employment, same or similar to the original occupation.
  • Factors considered for "same or similar" occupation.
